FIREWORKS & THE UK LAW Q&A

Can anyone buy fireworks?

You can't buy "adult" fireworks if you're under 18 years of age anywhere in the UK.

What are adult fireworks?

Adult fireworks are category 2 and 3 fireworks - they don't include things like party poppers or Christmas Crackers.

Can I buy fireworks all year?

Yes, you can legally buy fireworks all year round, however the company you are buying from must have a licence to sell all year like us at Temple Fireworks Ltd.

Can I set fireworks off at any time, day or night?

It’s against the law for anyone to set off fireworks between 11pm and 7am, except on certain occasions.

What occasions can I set fireworks off after 11pm and before 7am?

Bonfire Night, when the cut off is midnight. New Year’s Eve, Diwali and Chinese New Year, when the cut off time is 1am.

Can I use fireworks wherever I want?

The law states you must not set off or throw fireworks (including sparklers) in the street or any other public places.

Can I buy as many fireworks as I want?

It's a tricky one as you are personally responsible for the number of fireworks you purchase and possess at one time but legally you are permitted by UK law to store up to a maximum of 50kg (NEC) of 1.4g Fireworks for 21 days and 5kg (NEC) of 1.3g Fireworks for 3 days.

What does NEC weight mean?

NEC is the Net Explosive Weight and not the total gross weight of the firework.

If I don't use all my fireworks on Bonfire Night, will they keep until New Year's Eve?

We don't suggest you store any fireworks for long periods of time because of safety reasons but as long as they are stored in a cool and dry, safe location your fireworks will be fine for NYE.

My garden isn't very big but I want massive fireworks! Is this ok?

Simple answer is no. It is always best to look at the category of the firework first. Category 1 fireworks are classed as indoor fireworks. Category 2 fireworks are those which are suited to smaller back gardens and have a minimum safety distance of 5 or 8 metres. Category 3 fireworks are suited to larger gardens and public displays and have a minimum safety distance of 25 metres.

What fireworks are illegal to purchase and use?

Category 4 fireworks, these can only be used by trained professionals in conjunction with a licenced and insured company.

I have heard that I can buy reloadable fireworks that fit inside a tube, is this legal?

These are called shells that fire out of mortar tubes, they were banned from sale to the general public in 1997 after a few tragic accidents and fatalities. They are now classified as Category 4 (professional use only) fireworks. If you are offered these by a shop or anyone please be smart and contact your local trading standards or police.

If you find or you're given any fireworks, professional or not, you should contact your local (licenced display company) or trading standards office immediately. Shells are highly dangerous if loaded or fired incorrectly and can easily cause massive life changing injuries or death and all category 4 fireworks are extremely dangerous to untrained users.

If you are caught illegally storing or using category 4 fireworks you will face a very large fine and quite possibly prison.

Can I buy firecrackers that you throw on the ground?

No, all firecrackers were banned many years ago in the UK.

Can I buy the little bottle rockets that whistle and bang?

No these were banned many years ago in the UK.

I live near an airport, can I still have a fireworks party in my garden?

Depends on the type of fireworks and your distance from the airport. Please check with your local council to find out about any local rules for setting off fireworks especially when near airports.

I buy my fireworks from a supermarket and discount store because the prices are cheaper and they never bother asking me where I use them or how big the garden is, why should I buy from you?

It's a fair question but an easy one to answer. First of all, our prices via our Members Area are as cheap, if not cheaper than supermarkets and discount stores but the most important part, this is what we do all year round so you know the quality will be second to none, we also offer you unbeatable service and advice. We want to make sure that when you leave our shop you feel confident in the quality of your fireworks and that you know how to use them safely. If needed we can also offer you a firing order for your purchase so you get the maximum out of your display. No discount store or supermarket will ever do that!

A simple analogy would be: You wouldn't go to the dentist for a haircut so why trust your safety when purchasing fireworks from someone who sells fruit and veg all year at a supermarket? My advice is buy from trusted professionals, all year round "licenced" firework companies, because your safety and your families safety comes first.

If there are any questions or concerns you might have that are not listed above, please contact us and we will try our very best to accurately answer them for you.
